1. Scope and General Provisions

1.1. These Terms and Conditions apply to all orders placed through our online shop by customers residing in Switzerland, Liechtenstein, and European Union (EU) member states.

1.2. By placing an order, you agree to be bound by these Terms and Conditions.

2. Offer and Formation of Contract

2.1. The presentation of products in our online shop does not constitute a legally binding offer, but an invitation to order.

2.2. By clicking the order confirmation button, you place a binding order for the items in your shopping cart. A contract is formed when we send an order confirmation email or dispatch the goods.

3. Prices, Shipping Costs, and Customs Duties / Taxes

3.1. All prices are quoted in the currency specified in the shop (e.g., CHF or EUR).

3.2. Shipping costs will be clearly calculated and displayed during the checkout process before you finalize your order.

3.3. International Orders / Customs Duties: For deliveries outside of Switzerland (including all EU countries), the customer is solely responsible for paying all applicable import duties, customs charges, local taxes, and clearance fees levied by the destination country upon arrival.

4. Delivery and Shipping

4.1. Goods will be dispatched to the delivery address provided by the customer.

4.2. Estimated delivery times provided during checkout are for orientation only and are not legally binding guarantees.

5. Return and Exchange Policy

5.1. No Returns or Exchanges for Sizing: Please check our sizing charts carefully before ordering. We do not accept returns, exchanges, or refunds for items due to incorrect sizing or a change of mind.

5.2. Defective or Damaged Goods: If you receive an item that is defective or damaged upon arrival, you must report it to us at info@ursine.ch within 7 days of receiving the package, including your order number and photo evidence of the defect.

5.3. Upon verifying the defect, we will arrange for a replacement or issue a full/partial refund at our discretion. Returned items must be unworn, unwashed, and with original tags attached.

6. Warranty and Liability

6.1. We warrant that goods comply with the ordered specifications and are free from material manufacturing defects.

6.2. Statutory warranty rights are strictly limited to damaged or defective items as outlined in Section 5.

6.3. To the extent permitted by law, liability for indirect damages, consequential loss, or delays caused by customs authorities is excluded.

7. Governing Law and Jurisdiction

7.1. These Terms and Conditions are governed by and construed in accordance with the laws of Switzerland, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

7.2. The legal venue for any disputes arising from these Terms is the competent court at the registered location of Kammermann Sports (Kaufdorf, Switzerland). Mandatory consumer protection rights under the laws of EU member states remain unaffected where applicable.
